Federal Energy Regulatory Commission  Overview

The Federal Energy Regulatory Commission (FERC) includes provisions to retain electronic messages. Public utilities and natural gas companies are subject to (FERC) records retention regulations 18 CFR Parts 35 for electric energy and FERC regulation 18 CFR PART 284 for natural gas.

The following businesses as defined by the Federal Energy Regulatory Commission are required to retain their electronic messages.

  • Public Utilities
  • Natural Gas Companies
  • Electric Producers
  • Gas and Oil Production and Training

What are the Sections of FERC that are Relevant?


FERC Regulation 18 CFR PART 35
(d) Record retention. Seller must retain, for a period of three years, all data and information upon which it billed the prices it charged for the electric energy or electric energy products it sold pursuant to seller’s market based rate tariff, and the prices it reported for use in price indices.

FERC Regulation 18 CFR PART 284
(b) A blanket marketing certificate holder shall retain, for a period of five years, all data and information upon which it billed the prices it charged for the natural gas sold pursuant to its market
based sales certificate or the prices it reported for use in price indices.

(b) A pipeline that provides unbundled natural gas sales service under § 284.284 shall retain, for a period of five years, all data and information upon which it billed the prices it charged for natural gas it sold pursuant to its market based sales certificate or the prices it reported for use in price indices.
